1. GENERAL PROVISIONS

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ZBD Studio ("Company", "we", "us", or "our"), concerning your access to and use of the VibeDict platform (the "Service"). By accessing the Service, you confirm that you have read, understood, and agreed to be bound by all of these Terms.

1.2 Amendments

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will alert you about any changes by updating the "Last updated" date of these Terms.

2. MERCHANT OF RECORD

Our order process is conducted by our online reseller, Creem. Creem is the Merchant of Record for all our orders. Creem provides all customer service inquiries and handles returns.

By purchasing a subscription, you agree to be bound by Creem's Terms of Use and Privacy Policy in addition to these Terms. All billing and transaction disputes are subject to Creem's policies.

3. INTELLECTUAL PROPERTY & AI CONTENT

3.1 Platform Ownership

Unless otherwise indicated, the Service is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") are owned or controlled by us or licensed to us.

3.2 User Rights & Commercial Use

Subject to your compliance with these Terms, you own the rights to the specific stories and images you generate using VibeDict. You are free to use them for personal or commercial purposes. However, you may not use the Service to generate content that violates any laws or third-party rights.

3.3 AI Disclaimer

Our Service utilizes advanced Artificial Intelligence (AI) models. You acknowledge and agree that:

• AI output may not always be accurate, complete, or factually correct.
• No Copyright Guarantee: The legal status of AI-generated works varies by jurisdiction. We make no warranty regarding your ability to copyright generated content.
• Safety Filters: The Service may occasionally generate offensive content due to the nature of AI models, though we implement safety filters to minimize this risk.

4. USER CONDUCT & PROHIBITED CONTENT

4.1 Prohibited AI Content

To ensure compliance with legal standards and our payment processor policies, you are strictly prohibited from using VibeDict to generate:

• Unauthorized Portraits: Realistic likenesses, deepfakes, or stylized portraits of real persons (including celebrities and political leaders) without explicit authorization.
• NSFW & Harmful Content: Sexually explicit, violent, hateful, discriminatory content, or content that encourages illegal activities.
• Infringing Content: Content that violates third-party intellectual property rights.

4.2 Enforcement

VibeDict reserves the right to monitor user-generated content using automated filtering systems. Accounts found attempting to bypass safety filters (e.g., via prompt engineering) may be suspended or permanently terminated without refund.

5. SUBSCRIPTIONS, PAYMENTS & CREDITS

5.1 Billing & Renewal

Your subscription will automatically renew at the end of each billing cycle. You authorize us (via Creem) to charge your payment method for the renewal term. You can cancel at any time, and changes will take effect at the end of the current paid term.

5.2 Vibe Credits Policy

Certain features require "Vibe Credits".

• No Monetary Value: Credits are virtual goods and cannot be transferred or redeemed for cash.
• Expiration: Monthly credit allocations reset on each billing date. Unused monthly credits do not roll over to the next billing period.
• Consumption Order: Credits are consumed in the following order: Daily Free Credits → Monthly Plan Credits → Bonus Credits.

5.3 Refund Policy

We offer a 14-day money-back guarantee for first-time subscription purchases only, subject to the following strict condition to prevent abuse:

• Usage Limit: Refunds are only available if less than 30% of the monthly credit allocation has been consumed.
• If you have used more than 30% of your credits, or if this is a renewal charge, no refund will be issued.

6. LIMITATION OF LIABILITY

IN NO EVENT WILL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF.
